User Agreement

This User Agreement ("Agreement") governs your use of the Ted, Smart Teddy connected plush toy (the "Device"), the Ted&Co mobile application (the "App"), the website www.tedco.ai, and all related services, software, and features provided by Ted&Co SAS (collectively, the "Services"). By downloading the App, creating an account, purchasing the Device, or otherwise using the Services, you agree to be bound by this Agreement. If you do not agree to these terms, do not use the Services.

The Services are operated by Ted&Co SAS, a company incorporated under French law, with its registered office at 100 rue Saint-Dominique, 75007 Paris, France.

2. Who May Use the Services

The Services are intended for use by parents and legal guardians. By using the Services, you confirm that you are at least 18 years of age, or that you are using the Services under the supervision of a parent or legal guardian who accepts this Agreement.

Ted, Smart Teddy is designed for children aged 3 years and older. Small components may present a choking hazard if improperly handled. Parents and guardians are solely responsible for supervising their child's use of the Device.

3. The Device and Services

Ted, Smart Teddy is a connected interactive plush toy with an embedded voice module that enables AI-powered conversations. The Services include:

The physical Device (Ted, Smart Teddy)
Firmware and software embedded in the Device
The Ted&Co parental control mobile application
Cloud connectivity services required for operation

Some features require an active internet connection. If connectivity is unavailable, certain functions may not work. Ted&Co does not guarantee continuous, uninterrupted availability of the Services.

4. Artificial Intelligence and Generated Content

Ted, Smart Teddy uses artificial intelligence technology to generate voice responses. These responses are produced automatically by AI systems and may rely on third-party AI providers. Due to the inherent nature of AI, responses may contain inaccuracies or unexpected content. The Device is intended for entertainment and general interaction only.

Ted, Smart Teddy is NOT a teacher, therapist, babysitter, caregiver, medical professional, or licensed advisor. AI-generated responses must not be relied upon for professional advice, educational guarantees, safety-critical decisions, or child supervision.

Parents and guardians remain solely responsible for supervising all interactions between children and the Device.

5. Parental Controls

The App provides parental control features that allow you to configure safety settings, adjust interaction preferences, and manage device operation. While Ted&Co implements safeguards to reduce the likelihood of inappropriate content, no filtering system is perfect.

Ted&Co does not guarantee that all undesirable or inappropriate content will be prevented. Parents and guardians remain responsible for configuring available controls and supervising usage.

6. Ordering and Product Availability

Ted, Smart Teddy can be purchased at www.tedco.ai. The first production batch is limited to 300 units, processed on a first-come, first-served basis. Product availability cannot be guaranteed until an order is confirmed.

Ted&Co ships to customers in the United States and the European Union. Due to regulatory requirements, shipments to certain jurisdictions (including the U.S. state of Pennsylvania) may be restricted.

Delivery times are estimates only and are not guaranteed. Ted&Co is not responsible for delays caused by carriers, customs, or circumstances beyond its reasonable control.

7. Prices and Payment

All prices are displayed in the applicable currency at the time of purchase and may include or exclude taxes depending on your location. Ted&Co reserves the right to modify prices prior to order confirmation.

Payments are processed securely through Shopify Payments and PayPal. Ted&Co does not store your payment card information.

8. Returns and Refunds

You have the right to return your purchase within 14 days of delivery. To initiate a return, notify Ted&Co within this period by emailing hello@tedco.ai. Ted&Co will cover return shipping costs for eligible returns.

Returned products must be in good condition. Ted&Co reserves the right to inspect returned items before processing a refund. Refunds will be issued either to your original payment method or as store credit, at your election.

Note: As production is limited to 300 units, replacement availability may be limited if the batch is sold out.

9. Limited Warranty

Ted, Smart Teddy is covered by a 12-month limited warranty from the date of delivery, covering manufacturing defects under normal use. This warranty applies only to the original purchaser and is non-transferable.

The warranty does not cover damage resulting from misuse, accidents, unauthorized modifications, exposure to liquids, power surges, normal wear and tear, or cosmetic damage that does not affect functionality.

To submit a warranty claim, contact hello@tedco.ai with your order number and a description of the issue.

10. Electronic Components and Safety

The Device contains electronic components and a rechargeable battery. Do not attempt to open, modify, repair, or tamper with the internal components. Unauthorized modifications void the warranty and may create safety risks.

Charge the device using the provided method and under adult supervision. Do not expose the Device to water, excessive moisture, extreme temperatures, heat sources, or open flames.

11. Software Updates

The Device may receive remote firmware and software updates from time to time to improve functionality, enhance security, or introduce new features. By using the Services, you consent to the installation of such updates. Failure to install updates may result in reduced functionality.

12. Privacy and Data Protection

What We Collect

Ted&Co collects personal data necessary to provide the Services, including account information (parent email address, authentication credentials), order and shipping details, device operational data, and limited child information (name and age range) provided by the parent during setup.

Voice Interactions

When your child speaks to the Device, audio is temporarily processed to generate a response and may be transmitted to third-party AI providers. Ted&Co does not store raw audio recordings of children in the cloud. Full conversation transcripts are not retained in cloud systems. Voice interactions are processed ephemerally.

Interaction summaries may be stored locally within the App on your device. Operational device data is retained in cloud systems for a maximum of 7 days.

How We Use Data

We use personal data to operate and improve the Services, process orders, provide customer support, and send marketing communications where you have consented. Ted&Co does not use data for advertising profiling or to train AI models.

Data Sharing

Ted&Co does not sell personal data. Data may be shared with trusted service providers (payment processors, cloud infrastructure, AI providers) strictly for the purpose of operating the Services. Providers outside the EEA are subject to appropriate safeguards such as Standard Contractual Clauses.

Your Rights (GDPR)

Under the GDPR, you have the right to access, correct, delete, restrict, or port your data, and to object to certain types of processing. To exercise your rights, contact hello@tedco.ai. You also have the right to lodge a complaint with the CNIL (Commission Nationale de l'Informatique et des Libertés), France's data protection authority.

13. Acceptable Use

You agree not to misuse the Services. You must not reverse engineer, modify, tamper with, or attempt to bypass any security features of the Device or software. You must not use the Services for unlawful purposes or in any way that could harm others.

Ted&Co reserves the right to suspend or terminate your access to the Services if you violate this Agreement.

14. Intellectual Property

All intellectual property rights in the Services — including the Ted character, Ted&Co brand, software, voice system, mobile application, and website — are owned by Ted&Co or its licensors. Nothing in this Agreement grants you any rights to use Ted&Co's intellectual property beyond what is necessary for normal use of the Services.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Ted&Co is not liable for indirect, incidental, consequential, or punitive damages arising from your use of the Services, including damages resulting from reliance on AI-generated responses, loss of data, or service interruptions.

In all circumstances, Ted&Co's total liability shall not exceed the amount you paid for the product giving rise to the claim.

16. Governing Law

This Agreement is governed by the laws of France. Any disputes not subject to arbitration will be submitted to the competent courts of France, except where mandatory consumer protection laws in your jurisdiction provide otherwise.

For users located in the United States: disputes relating to the Services shall be resolved through binding arbitration where permitted by applicable law. By using the Services, you waive the right to participate in class actions against Ted&Co.

17. Changes to This Agreement

Ted&Co may update this Agreement at any time. Updated versions will be published on www.tedco.ai. Continued use of the Services after publication of an updated Agreement constitutes your acceptance of the revised terms.
